By ordering services from Arcane Graphics you are agreeing to the following:
We reserve the right to refuse to create anything which we may judge as unfit due to content or otherwise. This includes, but is not limited to, sites containing adult oriented material such as pornography, sites which promote hatred towards persons belonging to any ethnic group, religion or sexual orientation and sites which infringe copyright or are contrary to UK laws.
The acceptance of a commission shall be deemed as a contractual agreement between the client and Arcane Graphics.
Arcane Graphics cannot guarantee to start work immediately on a commission but will arrange a date with the client as to when work will commence.
Arcane Graphics insists on a deposit payment of a minimum of 30% of the agreed price upon the confirmation of the client’s order, after the first consultation. This will be deducted from the client’s bill and declared on their invoice.
All invoicing is initially delivered in electronic format to the client’s email address after the deposit payment is received and confirmed. A full paper invoice and record of purchase will be delivered to the client’s postal address when full payment is received. This will be sent with any printed materials, orders or CD-R discs requested. The client may request a paper invoice instead of the electronic version if desired.
All material, both text and images supplied by the client and used in the construction of the client's commission will remain the client's property. All such material will be assumed to be the property of the client and free to use without fear of breach of copyright laws.
Arcane Graphics cannot guarantee to perform all printing or manufacturing processes required for print commissions on behalf of the client, unless already arranged and paid for in advance as part of the invoicing. If printing cannot be arranged, Arcane Graphics will make every effort to refer the client to a reputable company, and provide any pricing information as necessary.
The copyright for all material provided by Arcane Graphics, such as HTML/CSS code, graphics, photographs and text, will remain the property of Arcane Graphics until such time as payment has been made in full whereupon they will become the property of the client.
Arcane Graphics makes every effort to design web pages which display acceptably in the most popular browsers, but cannot accept responsibility for pages which do not display acceptably in new versions of browsers released after pages have been designed.
Arcane Graphics will submit a client's website to several of the major search engines as part of the design commission. If a client wishes Arcane Graphics to promote a website as a separate commission, Arcane Graphics will make every reasonable effort to promote the website effectively, but cannot guarantee a high ranking in search engine results.
Arcane Graphics can accept no responsibility or liability if any search engine, online directory or search site, submitted to as part of a web site promotion commission, chooses not to list a client's web site.
Arcane Graphics will initially place the client's website on one of our demonstration subdomains during the design process in order that the client may view and comment upon the website's progress. When both Arcane Graphics and the client agree that the website meets the criteria agreed during the commissioning process, Arcane Graphics will invoice the client for the full amount due for the commission. On receipt of payment, Arcane Graphics will publish the website on the client's server, or provide the source code for the site via a download or CD-R for the client to upload themselves.
Any image files, documents or graphics pertaining to printed work and branding will be sent electronically to the client, and also placed on a CD-R disc accompanying any printed material purchased or copies thereof.
If at any point during the development process a client wishes to cancel their commission, they may do so, but will be invoiced an amount that Arcane Graphics judges to be proportional to the amount of work completed on the commission, up to the cancellation date.
If, during the development process, the client does not supply the information or content required in order to complete the commission within a reasonable time frame, Arcane Graphics will assume that the client wishes to cancel the commission. A reminder will be sent via the client’s preferred contact method before this occurs.
Arcane Graphics accepts Credit Card payments via PayPal, payments by Cash or Cheques (GBP) payable to Arcane Graphics within 14 days of the date on the invoice.
Any payment returned by the bank or credit card company will incur a £25 administration charge. This will be invoiced and will be added to the total outstanding debt owed by the customer.
Arcane Graphics does not agree to perform maintenance service, update or otherwise modify a client's website as part of the design commission. If a client wishes Arcane Graphics to maintain or update a website as a separate service, Arcane Graphics will negotiate a maintenance contract with the client appropriate to the amount of work required.
Arcane Graphics reserves the right to alter prices at any time without notice. If a client has commissioned any services from Arcane Graphics prior to a change in prices that commission will not be subject to any increase, but any subsequent commission will be charged at the altered price.
By agreeing to these terms and conditions your statutory rights are not affected.
Arcane Graphics reserves the right to alter, edit or modify these Terms & Conditions at any time without notice. If any of these changes effect a commission or service that was initiated before the changes took place, the client may assume that the previous version applies to their purchase. Any subsequent commissions will fall under the modified Terms & Conditions.
